A coletânea apresenta, sob a forma de artigos, problemas e soluções associados ao conceito e substância ao longo da história da filosofia. Sem pretender exaurir esse percurso, a coletânea contém 29 artigos redigidos por diversos especialistas brasileiros em Filosofia. Sua proposta é oferecer uma visão clara, acessível, precisa e atualizada desse recorte da história do conceito de filosofia, na expectativa de contribuir para o aperfeiçoamento do ensino e debate de filosofia no país. -/- The anthology presents, through a series of (...) articles, the intricacies of problems and solutions intertwined with the concept of substance across the annals of philosophical history. RESUMO O presente trabalho mostra as atividades realizadas do período de 01 de julho a 01 de novembro na JRM Agropecuária. As atividades foram desenvolvidas na área de bovinocultura de leite, este trabalho foi desenvolvido sob orientação do professor mestre Rodrigo Dorneles Tortorella e supervisão do médico veterinário André Ricardo, em conjunto com o médico veterinário Breno. Durante o período de estágio foi acompanhado as atividades realizadas no setor de manejo, reprodução, bezerreiro e recria da fazenda, além de acompanhar (...) as consultorias quinzenais realizadas pelos médicos veterinários. Este trabalho é composto pela descrição de estágio, referencial bibliográfico e relato de caso. O manejo reprodutivo pode trazer muito impactos econômicos se não for realizado de forma adequado, para trazer melhores resultados biotécnicas da reprodução foram criadas, como por exemplo a inseminação artificial, juntamente com ela, protocolos de inseminação são usados, para isso é necessário conhecer a anatomia do animal e a fisiologia do ciclo estral, trazendo então melhores resultados adequando a necessidade da propriedade. O relato de caso consiste na avaliação da taxa de concepção ao primeiro serviço de vacas leiteiras primíparas e multíparas no pós-parto em anestro, submetidas a uma pré-sincronização anterior a um protocolo de IATF, o qual obteve resultado e a maioria dos animais responderam a pré-sincronização, e as taxas de concepção foram superiores comparadas apenas a utilização de IATF, obtendo 37% de animais gestantes ao primeiro serviço. Given the importance of the principle of causality for the demonstration of God’s existence, this paper attempts to justify the evidence and necessity of the principle of causality, by following Fr. Fabro’s Thomistic defense—based on the notion of participation—but adding a particular emphasis on the notion of “being which is not per se,” this latter as an explanatory notion of the notion of “being which is by participation.” The introductory remarks touch upon two misunderstandings regarding the notion of participation employed (...) as a subject of the principle of causality: the first, considering “participated being” as a synonym of “received being,” and the second, the confusion, regarding the notion of being by participation, between its notional dependence on the notion of being as a whole and its real dependence on the real intensive Being. Then, in the first point, the defense of the principle of causality is distinguished from other related problems, like the particular applications of this principle. In the second and main point, we try to justify the necessity of being caused in the being which is experienced as being by participation, as follows: 1) that which is something by participation is not this something per se; 2) now, that which is not per se, either is not or is per aliud, 3) Therefore, that which is something by participation is per aliud. In the third and last point, we endeavor to justify the Thomism of our defense and of our emphasis on this notion of “being which is not per se” by considering two texts of St. Thomas. (shrink)

In the discourse on International Justice, traditional frameworks are deeply rooted in 'embodied metaphysics'—a perspective embedded in the tangible experiences of human existence. By contrasting the physical with the digital realms, I suggest that our current global justice systems are ill-equipped to address the complexities of the digital age. Utilizing the metaphor of water to highlight the often-unseen environment shaping justice theories and practices, I argue that International Justice, as conventionally understood, reflects the constraints akin to fish oblivious to the (...) water surrounding them. In digital spaces, individuals are no longer bound by principles of singularity and locality, and instead operate by principles of multiplicity and nonlocality. These metaphysical differences disrupt many theories of global justice assuming singularity and nonlocality. My aim is to encourage scholars and practitioners to 'see water'—to acknowledge and critically reassess the foundational assumptions underlying their theories and practices in an era of digital transformation. While virtually everyone recognizes the moral permissibility of whistleblowing under certain circumstances, most theorists offer relatively conservative accounts of when it is allowed, and are reluctant to offer a full recommendation of the practice as an important tool towards addressing ethical failures in the workplace. We think that accounts such as these tend to overestimate the importance of professional or personal obligations, and underestimate the moral obligation to shine light on severe professional malfeasance. Of course, a whistleblower, even an anonymous (...) one, often faces serious threats of retaliation and harm to their professional livelihoods and well-being. To address these challenges we argue in favor of a practice that we will call Preemptive Anonymous Whistleblowing (PAW). Such whistleblowing is preemptive in that a whistleblower provides information about malfeasance to a party in a position to do something about it without first raising the worry to one’s immediate superiors. At first blush, such preemption may seem unsettling, and PAW admittedly raises a number of worrisome issues. We defend PAW, however, as part of a larger argument that whistleblowing is morally required more often than is commonly thought. The availability of PAW as an option provides a method for allaying the concern that whistleblowing can be overly burdensome due to the risks of job and career. Insofar as that concern can be allayed, it is feasible for there to be substantial moral requirements to engage in whistleblowing in cases where severe harms can be prevented. With high enough stakes, there is a moral requirement for whistleblowing. (shrink)

I argue in this dissertation that natural properties play a central role in David Lewis' modal realism. To argue in favor of this thesis I present: a bottom-up explanation of a top-down possible world metaphysics; a new definition of natural properties and natural fusion, a new mereological operation. To achieve these aims, in the first chapter, I contextualize the discussion, in the second I resume the discussion about universals in contemporary philosophy and argue that, considering the distinct formulations of the (...) problem, class nominalism combined with modal realism might be the best solution. Furthermore, I discuss Devitt's solution in which he defends that the problem about universals is, in fact, a pseudo problem. In the third chapter, I introduce a minimal ontology of properties, regarding natural properties, I discuss the existing definitions, present a new one and discuss some theories of similarity, a notion that is in the core of the definition I propose. Besides, I present how natural properties benefit the definition of terms of nomological package, linked to its fundamentality role. I also present some applications related to the rationality role that encompass some well-known philosophical problems of the second half of 20th century. In the fourth chapter, I present some varieties of philosophical realism, I consider the theoretical advantages of taking scientific realism as background and I discuss one more utility of natural properties, the solution to the problem of eligibility of reference or, the Putnam's paradox. In the fifth chapter, I discuss how mereology is important to link several aspects of Lewis' modal realism. For such, I discuss the relation between composition as identity and ontological innocence of mereology and I present the natural fusion mereology, a new mereological operation that aims to minimize the problems of unrestricted composition. This paper describes a method for the analysis of the evolutionary path of a complex, dynamic, and contingent social phenomenon in an empirical setting. Given empirical evidence of a surprising or anomalous fact, which contradicts the prediction of the wide-acknowledged theory, the goal is to formulate a plausible explanation based on the context of occurrence, taking a holistic and historical point of view. The procedure begins by translating theoretical propositions into grammar rules to describe patterns of either individual action or (...) interaction that may occur within the hypothesized social system. The result is a category of social process in which the objects are types of decision-making events carried by a stable community of actors over time, and the relationships between them are state transitions revealed in the sequences of event outcomes. Therefore, structural comparison between pairs of representative instances result in an extension of the category of social processes, relying on the configurations of contextual conditions that enable the occurrence of the new event outcome in specific empirical settings. Durante los últimos años, el problema de cómo justificar aquellas creencias que se originan en testimonios ha ocupado un lugar central en la epistemología. Sin embargo, muy pocas de esas reflexiones son conocidas en el derecho probatorio. En el presente ensayo analizo la prueba testimonial a la luz de estas reflexiones con el fin de poner de manifiesto los supuestos epistemológicos de algunos principios procesales. En concreto, analizo la legislación colombiana y la estadounidense en el marco de la disputa entre (...) el reduccionismo y el antirreduccionismo en la filosofía del testimonio. Al final sugiero una nueva aproximación epistemológica que replantea los términos de la disputa y que tiene implicaciones importantes para la valoración de la prueba testimonial en los procesos judiciales. The present study aims at understanding how Ethica Nicomachea V.6 relates to its preceding chapters, V.1-5. On the one hand, the interpreter wonders for what purpose Aristotle introduces a topic named ‘the civic just’ (to politikon dikaion) in V.6, since V.1-5 treats extensively of matters of justice in the city. On the other hand, the same text posits that there is a certain ‘just without qualification’ (to haplōs dikaion), which may or may not be the civic just itself; compared to (...) the just without qualification, other forms of just are so by similitude (kath’homoiteta). In attempting to clear the confusion around those two points, the present study proposes the following: (1) the civic just is the just without qualification insofar as it is the primordial form of the just, in which only humans who are cumulatively free, equals and self-sufficient have a share; (2) the description of the civic just recapitulates several aspects of the discussions of justice in V.1-5 – the laws, the kinds of equality, rule, the legal suit - because the civic just encompasses all the forms of just (dikaion) related to the virtues of universal justice (V.1) and partial justice (V.2-5); (3) the expression to politikon dikaion is introduced in V.6 in order to contrast everything treated in V.1-5 with the domestic just, to oikonomikon dikaion, mentioned for the first time in V.6; (4) the forms of the domestic just are just only by similitude with the civic just because justice loses density outside the civic sphere, a situation which can be explained by the shortcomings Aristotle ascribes to women, children and slaves in EN V.6 (lack either of freedom or equality or yet self-sufficiency) as well as in Politica I (varying degrees of defective deliberation and virtue). A ideia da primeira parte deste e-book surgiu durante a disciplina de Tópicos Especiais em Políticas Linguísticas ministrada por mim no Programa de Pós-Graduação em Estudos de Linguagens (PPGEL) da Faculdade de Artes Letras de Comunicação (FAALC) da Universidade Federal de Mato Grosso do Sul (UFMS) durante o segundo semestre de 2023. A segunda parte da obra surgiu de afinidades teóricas e metodológicas entre as professoras do curso de Letras da UFMS (Campo Grande) que orientam os capítulos 7, 8 e (...) 9 e traz diferentes questões relacionadas ao ensino de línguas. [...] Por fim, espero que esta obra possa contribuir para ampliar e qualificar as reflexões acerca das temáticas aqui levantadas e que possa suscitar novas propostas de pesquisa ou de intervenção no ensino de línguas e nas Políticas Linguísticas. ¿Existe alguna diferencia filosóficamente significativa entre una explicación científica y las explicaciones que se ofrecen en el curso de la vida diaria? Dado que la mayor parte de las discusiones en la filosofía de la ciencia se refieren al primer tipo de explicaciones, debemos considerar si existe un concepto específico que corresponda al término “explicación científica”, y que sea discontinuo de su contraparte cotidiana. El ensayo tiene cuatro secciones. En cada una de ellas considero diferentes criterios que podrían ser utilizados (...) para establecer una distinción de clase entre las explicaciones científicas y las cotidianas. En la primera sección exploro la posibilidad de establecer un criterio puramente sociológico: el estatus científico de una explicación dependería del estatus institucional de las personas que dan origen a la explicación. El segundo criterio estudiado fue propuesto por Hempel: las explicaciones científicas deben hacer uso explícito de leyes naturales, y la ausencia de leyes invalida cualquier intento de ofrecer una explicación científica. Un tercer criterio se basa en la naturaleza del explanandum. Algunos filósofos han defendido la idea de que la única diferencia filosóficamente significativa entre las explicaciones científicas y las no científicas reside en el tipo de explanandum del que se ocupa cada una de ellas. En la vida diaria explicamos eventos individuales, mientras que en la ciencia se pretende explicar regularidades. Finalmente, examino el criterio propuesto por Wesley Salmon según el cual la diferencia entre los dos tipos de explicación está determinada por el tipo de comprensión que proporciona cada uno de ellos. Al final concluyo que ninguno de estos criterios es adecuado y que la aparente diferencia entre los dos tipos de explicaciones es una diferencia de grado y no de clase. Las explicaciones científicas ciertamente tienen un mayor grado de precisión, detalle y complejidad que sus contrapartes en la vida cotidiana. Normalmente involucran el uso de las matemáticas y de lenguajes altamente regimentados. Pero a pesar de estas diferencias, concluyo que los elementos que hacen que algo sea una explicación son esencialmente los mismos en ambos casos. (shrink)

Con el fin de examinar los aspectos exclusivamente morales del suicidio asistido y la eutanasia activa voluntaria, el análisis debe ser llevado a cabo independientemente de la función social de los agentes involucrados, de la opinión de los familiares del paciente terminal y del público en general, y de las consecuencias legales de dichas acciones. En consecuencia, en el presente ensayo se analiza un imaginario caso neutral, aislado del contexto natural de la eutanasia y el suicidio asistido. Utilizando un principio (...) moral—llamado PMS en el ensayo—cuya aplicabilidad depende de la apreciación subjetiva que de él hagan la persona que desea morir y el agente que asiste en su muerte, en el ensayo se concluye que en ciertos casos es posible justificar la obligación moral de asistir en un suicidio o de llevar a cabo una eutanasia activa voluntaria. El estudio evalúa los vínculos entre la transición energética existentes en América Latina y el Caribe y los Objetivos de Desarrollo Sostenible (ods) relacionados con la innovación (ods 9), la igualdad (ods 10) y las instituciones (ods 16). El estudio sostiene que, si las opciones de tecnología energética en la región continúan siendo impulsadas por la racionalidad tecnoeconómica, muchas demandas impuestas a la transición energética seguirán sin satisfacerse, es decir, no se resuelven los desafíos preexistentes (ods 9, 10 y 16). Por tanto, para que la transición energética sea equitativa y compatible con el clima, es necesario conceptualizar e implementar en la práctica nuevas formas de integrar y actuar sobre el conocimiento inter y transdisciplinario, lo que implica la creación de una interfaz entre las comunidades locales (conocimiento indígena y comunidad), comunidad de investigación (conocimiento local e internacional sobre clima-energía) y formuladores de políticas (conocimiento sobre políticas). These thirteen paragraphs portray epistemology as the study, not directly of knowing as a human action (which could be considered the object also of anthropology) but as the study of the mode of being of the object in the subject and, in this sense, of intentional being. Moreover, intentional being is not understood as the being of the cognitional species or representation, which is real and subjective, but as the being of the known, as the presence of the known to (...) the knower (obviously, through the species but a being not reduced to the subjective being of the species): this kind of being is the proper object of epistemology. Other considerations regarding the distinction between metaphysics and epistemology take place as well. As regards the method, this essay attempts to apply Aquinas’ four steps of scientific reasoning to epistemology, in the following fashion and order: 1- Solution of the problem of the universals by recourse to the theory of the agent intellect (resolutio secundum rem); 2- Definition of knowledge as intentional possession of being (res. sec. rationem); 3- Judgment of value regarding the different instances of human knowledge or critique of knowledge (compositio secundum rem) and 4- Reinterpretation (in the light of the previous path) of common notions of epistemology, such as truth, certainty, evidence, and error (comp. sec. rationem). Many word forms in natural language are polysemous, but only some of them allow for co-predication, that is, they allow for simultaneous predications selecting for two different meanings or senses of a nominal in a sentence. In this paper, we try to explain (i) why some groups of senses allow co-predication and others do not, and (ii) how we interpret co-predicative sentences. The paper focuses on those groups of senses that allow co-predication in an especially robust and stable way. El capítulo se concentra en cuatro temas principales: los criterios de demarcación entre el conocimiento científico y la pseudociencia; el carácter derrotable de las conclusiones de la ciencia y el (...) derecho; la estructura corroborativa de la relación entre la evidencia y las hipótesis científicas y judiciales; y las teorías de la explicación tanto en el ámbito científico como en el judicial. Kemp Smith ha demostrado que en esta sección del Tratado Hume estaba respondiendo a los argumentos que Pierre Bayle había utilizado para probar que el razonamiento humano siempre termina refutándose a sí mismo. En este ensayo expongo las falacias en los argumentos de Bayle, las cuales están basadas en una comprensión inadecuada del concepto de extensión. Hume no (...) logró detectar dichas falacias y repitió los mismos errores de Bayle, lo cual explica la absurda doctrina del espacio que defiende en el Tratado. (shrink)

Aunque el derecho probatorio y el derecho procesal se han dedicado desde siempre al estudio de los problemas relacionados con las pruebas y el establecimiento de los hechos en los procesos judiciales, el énfasis ha estado siempre en el aspecto formal, doctrinal y procedimental en detrimento de los fundamentos filosóficos y teóricos. Durante los últimos años ha habido un intento sostenido de explorar estos fundamentos combinando no sólo las herramientas tradicionales proporcionadas por la lógica, la gramática y la retórica, sino (...) también los avances hechos en ciencias como la estadística y la probabilidad, la medicina y la psicología forenses, la psicología de la percepción, la epistemología y la filosofía de la ciencia. El presente libro reúne las contribuciones de destacados juristas y filósofos latinoamericanos a esta nueva perspectiva interdisciplinaria, conocida como epistemología jurídica. El libro está dividido en tres grandes temas: la primera parte explora los problemas epistemológicos del conocimiento de los hechos en los procesos judiciales; la segunda se enfoca en el problema de los estándares de prueba; y la sección final discute el testimonio de los expertos. We show how a semantics based on Aristotle’s texts and ecthetic proofs can be reconstructed. All truth conditions are given by means of set inclusion. Perfect syllogisms reveal to be valid arguments that deserve a validity proof. It turns out of these proofs that transitivity of set inclusion is the necessary and sufficient condition for the validity and perfection of a syllogism. The proofs of validity for imperfect syllogisms are direct proofs without conversion in a calculus of natural deduction. Transitivity (...) of set inclusion turns out to be a necessary condition for the validity of imperfect syllogisms. As a consequence, it can be established what the main metalogical difference between a perfect and an imperfect syllogism is. The validity of the laws of conversion is also obtained by direct proofs. Finally, it is shown that and explained why some imperfect syllogisms satisfy the definition of a perfect syllogism. (shrink)

Philosophy can be regarded as a type of conceptual research subjected to the usual standards of rationality. However, there seems to be no objective and accepted criteria for evaluating and comparing philosophical theories. From a heuristic- and erotetic-based approach, philosophy is here considered a set of second-order reflections that are presupposed by more specific theories; and evaluated by their informativeness, adequateness, cogency, generality, novelty, and presuppositional nature. As a practice, one can proceed upwards (from problems to presuppositions) or downwards (from (...) presuppositions as meaning conditions for assertions under question). But as a product, a philosophical theory is to be assessed as how it helps foster knowledge and assists in learning, posing, and solving new queries. (shrink)

In this paper I argue that the search for explainable models and interpretable decisions in AI must be reformulated in terms of the broader project of offering a pragmatic and naturalistic account of understanding in AI. Intuitively, the purpose of providing an explanation of a model or a decision is to make it understandable to its stakeholders. But without a previous grasp of what it means to say that an agent understands a model or a decision, the explanatory strategies will (...) lack a well-defined goal. Aside from providing a clearer objective for XAI, focusing on understanding also allows us to relax the factivity condition on explanation, which is impossible to fulfill in many machine learning models, and to focus instead on the pragmatic conditions that determine the best fit between a model and the methods and devices deployed to understand it. After an examination of the different types of understanding discussed in the philosophical and psychological literature, I conclude that interpretative or approximation models not only provide the best way to achieve the objectual understanding of a machine learning model, but are also a necessary condition to achieve post hoc interpretability. This conclusion is partly based on the shortcomings of the purely functionalist approach to post hoc interpretability that seems to be predominant in most recent literature. (shrink)

Our purpose is to defend the possibility of “perceptualism,” that is to say, the position maintaining that the intelligible content of consciousness is given in perception and not posited by the activity of the subject. Assisted by the insights of Cornelio Fabro, this defense contrasts perceptualism with Bernard Lonergan’s “critical realism”. This paper deals with the mutations in Wittgenstein’s treatment of the notions of “generality” and of “singularity”, from his first philosophy, in the Tractatus Logico-Philosophicus, to his later mature philosophy represented by the Philosophical Investigations. As we shall see, Wittgenstein’s philosophical handling of the notion of “visual perception” plays a key role in those conceptual transformations.

There is a difference between the tasks of interpreting Sextus Empiricus and contesting his arguments. Usually, one does the latter relying on some version of the former. Though this seems obvious, it is easy to make mistakes in this endeavor. From this point, I draw two basic recommendations which we should follow, lest we take Sextus to hold implausible positions regarding his Five Modes. However, these recommendations lead us to interpret Sextus’ Pyrrhonism as a limited skepticism. In the final section, (...) as I suggest a counter-example to this commitment, I reconsider the notion of infinite (apeiron) in the Five Modes to better explain interpretation and criticism of Sextus’ arguments. The objective of this article is to try to elucidate Wittgenstein’s ex-travagant thesis that each and every mathematical advancement involves some “semantical mutation”, i.e., some alteration of the very meanings of the terms involved. To do that we will argue in favor of the idea of a “modal incompati-bility” between the concepts involved, as they were prior to the advancement, and what they become after the new result was obtained. We will also argue that the adoption of this thesis profoundly (...) alters the traditional way of con-struing the idea of “progress” in mathematics. (shrink)

This work presents a post-positivist research framework to explain any surprising fact in the evolutionary path of a complex, dynamic and contingent social phenomenon. Primarily, it reconciles the ontological and epistemological assumptions of Critical Realism with the principles of American Pragmatism. Then, the research approach is presented: theoretical propositions about a social structure are translated into a set of grammar rules that acknowledges a pattern of sequences of events of either individual action or social interaction between actors within a real (...) social system. The result is a discrete mathematical model for a concrete category of social process based on these rules. Finally, data-grounded refinement of the theory is possible by the comparison between cases belonging to the same category, but differing about some contingent pattern of sequences of event outcomes. Consequently, their grammars differ in some pairs of context-sensitive rules that can explain this surprising fact, such that the derivation of this alternative historical trajectory of event outcomes becomes an extension to the early category of social process. In this sense, the proposed framework suggests there is a hierarchy of classes of grammars for middle-range explanations based upon the ontological assumption of the generative nature of social reality. Philosophical problems about the part-whole relation have been discussed throughout the history of philosophy, at least since Plato and Aristotle. In contemporary philosophy, the understanding of these issues has benefited from the formal tools of Classical Extensional Mereology. This paper aims is to defend mereological restrictivism against some constraints imposed by the vagueness argument. To achieve this, the paper is divided into three parts. In the first, I introduce the special composition question (hereafter SCQ) as formulated by [Van Inwagen, 1990] (...) and briefly present the three sets of theories that proffer answers to it. In the second part, I focus on the vagueness argument, that was presented by [Lewis, 1986, ] and [Sider, 2007, ] to defend mereological universalism. In the third section, I introduce the theory of natural properties by David Lewis. From this theory, I propose a new mereological operation labeled as natural fusion. The purpose of this operation is to falsify one of the premises of the vagueness argument. Then, I discuss some examples and counter-examples to natural fusion. (shrink)

According to Molinism, logically prior to his creative decree, God knows via middle knowledge the truth value of the counterfactuals or conditionals of creaturely freedom (CFs) and thus what any possible person would do in any given circumstance. Critics of Molinism have pointed out that the Molinist God gets lucky that the CFs allow him to actualize either a world of his liking or even a good-enough world at all. In this paper, I advance and strengthen the popular critique in (...) two ways. First, I specify the kind of luck to which God is subject, which is circumstantial moral luck. Second, and more importantly, I argue that exposure to this luck is problematic because something external to God and beyond his control determines the degree of praiseworthiness he deserves in relevant possible worlds. My main contention is that divine subjection to circumstantial moral luck raises the theoretical costs of Molinism. (shrink)

O objetivo geral da pesquisa da qual esse artigo faz parte é investigar o sistema metafísico que emerge dos trabalhos de David Lewis. Esse sistema pode ser decomposto em pelo menos duas teorias. A primeira nomeada como realismo modal genuíno (RMG) e a segunda como mosaico neo-humeano. O RMG é, sem dúvida, mais popular e defende a hipótese metafísica da existência de uma pluralidade de mundos possíveis. A principal razão em favor dessa hipótese é a sua aplicabilidade na discussão de (...) problemas losó cos, esse motivo não será diretamente abordado neste artigo. Pois, o foco está em compreender o mosaico neo-humea- no e como ele relaciona-se com a metafísica de mundos possíveis. Em outras palavras, o meu objetivo é entender as bases losó cas que sus- tentam o realismo modal genuíno. (shrink)

Moore’s Paradox is a test case for any formal theory of belief. In Knowledge and Belief, Hintikka developed a multimodal logic for statements that express sentences containing the epistemic notions of knowledge and belief. His account purports to offer an explanation of the paradox. In this paper I argue that Hintikka’s interpretation of one of the doxastic operators is philosophically problematic and leads to an unnecessarily strong logical system. I offer a weaker alternative that captures in a more accurate way (...) our logical intuitions about the notion of belief without sacrificing the possibility of providing an explanation for problematic cases such as Moore’s Paradox. There is a growing awareness that there are many subtle forms of exclusion and partiality that affect the correct workings of a judicial system. The concept of epistemic injustice, introduced by the philosopher Miranda Fricker, is a useful conceptual tool to understand forms of judicial partiality that often go undetected. In this paper, we present Fricker’s original theory and some of the applications of the concept of epistemic injustice in legal processes. In particular, we want to show that the seed (...) planted by Fricker has flourished into a rich field of study in which the concept is used to analyze many different phenomena in law, not always following the original characterization provided by her. This has led to a distinction between what we will call the narrow version of the concept, which is closer to Fricker’s original account, and the wider version of epistemic injustice, which is a more controversial notion because it is always on the verge of morphing into other well-known concepts like sexism, racial discrimination, oppression, silencing, and gaslighting. We will show that the value of the narrow version is mostly theoretical, and that in order to use the concept of epistemic injustice one must adopt a more liberal understanding of it. (shrink)

Testimony about the future dangerousness of a person has become a central staple of many judicial processes. In settings such as bail, sentencing, and parole decisions, in rulings about the civil confinement of the mentally ill, and in custody decisions in a context of domestic violence, the assessment of a person’s propensity towards physical or sexual violence is regarded as a deciding factor. These assessments can be based on two forms of expert testimony: actuarial or clinical. The purpose of this (...) paper is to examine the scientific and epistemological basis of both methods of prediction or risk assessment. My analysis will reveal that this kind of expert testimony is scientifically baseless. The problems I will discuss will generate a dilemma for factfinders: on the one hand, given the weak predictive abilities of the branches of science involved, they should not admit expert clinical or actuarial testimony as evidence; on the other hand, there is a very strong tradition and a vast jurisprudence that supports the continued use of this kind of expert testimony. It is a clear case of the not so uncommon conflict between science and legal tradition. (shrink)

In the natural and social sciences, it is common to use toy models—extremely simple and highly idealized representations—to understand complex phenomena. Some of the simple surrogate models used to understand opaque machine learning (ML) models, such as rule lists and sparse decision trees, bear some resemblance to scientific toy models. They allow non-experts to understand how an opaque ML model works globally via a much simpler model that highlights the most relevant features of the input space and their effect on (...) the output. The obvious difference is that the common target of a toy and a full-scale model in the sciences is some phenomenon in the world, while the target of a surrogate model is another model. This essential difference makes toy surrogate models (TSMs) a new object of study for theories of understanding, one that is not easily accommodated under current analyses. This paper provides an account of what it means to understand an opaque ML model globally with the aid of such simple models. (shrink)

Why I thought it useful to offer an explanation of Hegel’s doctrine on the Incarnation was so that the reader may be empowered to identify Hegel’s influence in modern accounts of this mystery. Even if, in my view, Hegel’s interpretation of revealed religion differs greatly from Catholic Doctrine, it is not surprising to find the presence of some of his concepts in modern theology. In truth, what matters is not the theologian’s self-identification as Hegelian or as non-Hegelian, but whether or (...) not the theologian adopts Hegel’s concepts. This paper offers an explanation of the internal dynamism of Hegelian concepts and their relation to Christian doctrine in Hegel’s Phenomenology of Spirit. This research may help to show in what way it is possible to explain Christian religious doctrine with a philosophy other than the Thomistic one and how, at least in Hegel’s case, religious doctrine is changed and reduced to an erroneous philosophical content. Also, an attempt is made to show the internal “coherence” of this Hegelian re-reading of Christianity so that theologians may become more cautious about accepting an explanation of Christian doctrine simply because the Christian language is preserved in that explanation. This paper offers a new interpretation for Wittgenstein`s treatment of mathematical identities. As it is widely known, Wittgenstein`s mature philosophy of mathematics includes a general rejection of abstract objects. On the other hand, the traditional interpretation of mathematical identities involves precisely the idea of a single abstract object – usually a number –named by both sides of an equation.

The aim of this paper is to clarify the truth-functional interpretation of the logical connective of the material implication. The importance of such clarification lies in the fact that it allows avoiding the supposed paradoxes introduced by C. I. Lewis (1918). I argue that an adequate understanding of the history and purposes of logic is enough to dissolve them away. The defense is based on an exposition of propositional compositionalism. To compare, I also present Stalnaker’s (1968) alternative that seeks to (...) explain the implicit concept of conditionality of conditionals assertions. In order to reinforce my aim I expound the twelve different meanings of ‘implication’ stated by Corcoran (1993) in order to hold that a proper understanding of these meanings allows us to avoid ambiguities and confusions. Finally, I expect to show that despite the possible alternatives, compositionalism is still the best explanation for the truth-functionality account of logical connectives. (shrink)

I present in this note an alternative answer to the princesses' earring problem, found in the first chapter of Cezar Augusto Mortari's book "Introdução à Lógica”.

What is the distinction between understanding and forming a concept? In my view, for Aquinas, intelligere (the act of understanding) and dicere (the forming of a verbum or mental word) are not two different acts, but simply two different aspects of the same act of understanding. In the following, I will explore more in depth what this distinction means for Aquinas. Firstly, I will give a mostly doctrinal or systematic overview of the issue and, secondly, I will support my claims (...) with relevant textual evidence, taken exclusively from Aquinas’ Summa Theologiae. This study, as an appendix, is part of “The Influence of Kant in Transcendental Thomism: Rahner, Lonergan and Von Balthasar” (forthcoming). In my view, Lonergan’s way of distinguishing intelligere and dicere is different from St. Thomas’ way. In the body of my book, I focus on Lonergan’s reasons to distinguish these notions in his own particular way, whereas this study focuses on St. Thomas’ doctrine. It is my hope that the following lines will foster an understanding of St. Thomas’ epistemology and of its application to Trinitarian theology. (shrink)

This paper elaborates on relationalism about space and time as motivated by a minimalist ontology of the physical world: there are only matter points that are individuated by the distance relations among them, with these relations changing. We assess two strategies to combine this ontology with physics, using classical mechanics as example: the Humean strategy adopts the standard, non-relationalist physical theories as they stand and interprets their formal apparatus as the means of bookkeeping of the change of the distance relations (...) instead of committing us to additional elements of the ontology. The alternative theory strategy seeks to combine the relationalist ontology with a relationalist physical theory that reproduces the predictions of the standard theory in the domain where these are empirically tested. We show that, as things stand, this strategy cannot be accomplished without compromising a minimalist relationalist ontology. (shrink)
